Jeff Masters is a litigation partner and member of the Insurance and Risk Management Practice Group. He and the Group serve project owners, investors, developers, public and privately-held homebuilders, and contractors.

He prosecutes complex insurance coverage claims and litigation against insurers in California and nationally. In his national transactional practice, Jeff provides strategic insurance and risk management legal counsel on:

  • Negotiating and implementing liability and property insurance programs, with particular focus on rolling and project-specific commercial and residential wrap-ups (OCIPs and CCIPs), professional liability programs, and commercial property and builder's risk programs;
  • Analyzing and manuscripting the terms and conditions of commercial insurance policies;
  • Negotiating and documenting risk transfer provisions in design and construction contracts, including indemnification, insurance, damages waivers, performance standards, and limitations of liability;
  • Designing and implementing risk management, contractual risk transfer, and insurance programs for major residential, commercial, and mixed use projects, including design peer review and construction quality assurance (QA) programs, warranties, customer service operations, and risk transfer provisions in JV agreements, loan documents, leases, management agreements, and other real estate contracts;
  • Executing portfolio-level, entity, and project exit strategies, including indemnification regimes and insurance for post-dissolution completed operations risks, and the effect of dissolution on existing insurance coverages; and
  • Managing and insuring risk in the acquisition, repositioning, operation, and disposition of REO and other distressed real estate assets, condominium conversions, shelf condominiums, and adaptive reuse projects.
